Terms of Service
These Terms of Service apply to the ServerBlend website located at serverblend.com and all services provided by ServerBlend, a trading name of Interiginal LTD. By using the site or ordering any services, you agree to these Terms of Service, if you do not agree, do not use the website or services. Interiginal LTD, agrees to provide services and access to the website to the client, subject to the following (“Terms of Service”). ServerBlend is a trading name of Interiginal LTD, the company here after referred to as, (“ServerBlend“), (“Us”), (“We”) and The Client, (“Customer”), (“Client”) and (“You”). Use of ServerBlend’s services, including the ServerBlend website constitutes acceptance and agreement to the Terms of Service. ServerBlend reserves the right, at its sole discretion, to modify, add, or remove parts of the Terms of Service, at any time. It is your responsibility to check these Terms of Service regularly for any changes. Your continued use of the ServerBlend website or services following any changes being made will mean that you accept and agree to the changes. As long as you comply with these Terms of Service, ServerBlend grants you a personal, non-exclusive, non-transferable, limited privilege to enter and use the website and its services.
The legal company you are bound with for these Terms of Service is Interiginal LTD, registered in England and Wales, company number 9459736. The terms of Service applies and will be governed by the law of the United Kingdom, any disputes will be settled in a court of law in the United Kingdom.
ServerBlend provides a 14 day satisfaction based refund policy for the majority of provided services, when a service applies for a refund policy it will be shown on the associated services page on the ServerBlend website, and it will not be included in the exclusions shown in section 1.1.1 of these Terms of Service. If the service is eligible for a refund within the 14 day period, you can cancel the service and claim a refund by submitting a ticket through your client area. After 14 days, all services are non-refundable. All payments made for a services renewal are non refundable.
Refunds will always be sent back through the payment gateway chosen when the payment was made, for example; a PayPal payment, will be sent back to your PayPal account, and the account that the payment was made with. Refunds cannot be sent to different payments accounts.
Refunds are only provided for dissatisfaction with the service provided. Requests must be accompanied by a valid, justifiable reason, which will be solely decided by ServerBlend.
The reason must be directly associated with the service provided to you, such as but not limited to, slow support ticket replies. The client must give ServerBlend one opportunity to resolve the issue within 48 hours. Refunds are not given for issues outside of ServerBlend’s control, such as but not limited to, a bug in the game or a natural disaster. We provide a standard 24 hour refund policy for the same services which we provide the 14 day satisfaction refund to, for changes of mind, or issues with the game causing you to be unable to use the server in the way you wanted to when purchasing.
For Space Engineers or Medieval Engineers servers that are lagging, we have a special guarantee that we will resolve the lag issue, or your money back. We offer this because we find that in almost all cases, the lag issue can be resolved. If its found that the lag issue is caused by a mod, configuration option, script, amount of objects in the world, or amount of resource intensive blocks in the world, we will provide a solution to this, for example but not limited too, removing the mod, changing the setting, reducing the objects or resource intensive items in the world, removing the bad script or upgrading to a more powerful server. It is then the clients responsibility to take the advised action, at this point a refund is then no longer possible due to the issue being found and a solution being provided. If we find that the lag is caused by a bug in the game or an external network issue, we cannot provide refunds for this as it is outside of our control. The amount of money refunded depends on the services billing term, and does not include any service addons. For monthly billing terms, we refund the amount of your last months game server service, this might not be the full invoice value as this does not include addons such as but not limited to, our management service addons. If you are on a quarterly, semi-annual or annual prepaid billing term, we would refund an amount based on the amount of time left on your current billing term. ServerBlend will have the final decision to decline refunds if it solely deems that it is not within the terms of refund.
1.1.1 Refund Exclusions
- Service add-ons, which are optional extras chosen either during the service checkout process or chosen after and are added onto the service are excluded from our refund policy. For example but not limited to the add-ons: “Monitor and fix”, “Custom sub-domain”, “Initial admin configuration / mod installation”, or any custom work done to your server which has been partly or fully completed.
- Dedicated servers
- Upgrades. If applicable, some services can be downgraded again and receive a credit to the clients account.
ServerBlend is a trading name of Interiginal LTD, therefore payment invoices, statements, “pay to” and other transactions will show that it is to Interiginal LTD. On some bank statements when paid by debit or credit card, the paid to on the statement may just show: ServerBlend. Invoices will be delivered to you by email, you agree that once we send the email, it then leaves our system and is therefore out of our control, we are not responsible for undelivered emails once they leave our system.
First time order invoices must be paid within 24 hours of placing the order. If payment is not delivered within 24 hours we reserve the right to cancel the order without informing you. You will then need to submit a new order when you wish to proceed again. Repeated orders with no invoice payment may lead to the account being closed.
1.2.1 Country of Residence
You agree that the country of residence that you supply during order with your account details, or any residence it is changed to after creation is true. If you supply an invalid country of residence you will be fully liable to any legal action taken for unpaid vat due to this.
1.3 Payment Methods
With PayPal you can pay with a one time payment, where the invoice must be paid manually each time, you can setup a recurring payment, or you can setup an auto payment using reference transactions.
188.8.131.52 Recurring Payments
This method will pay us a set amount each time your service renews. Such as but not limited to: Monthly, quarterly, or semi annually.
This can be cancelled at any time through your PayPal account, by contacting us, or by cancelling your service.
184.108.40.206 Auto Payment
This method will allow us to charge your PayPal account the amount required, when required, for example but not limited to: when you upgrade your account, we will charge you more, or when you downgrade your account or we have applied credit to your account you will be charged less. You agree to be charged on demand varying amount using this method for your ease of payment. Please see section 1.8 for more information on varying amounts. With this method, you never need to add in your PayPal payment information again unless this method agreement cancelled, and you will never over, or under pay.
All charges will be invoiced for, and you will see a full history of payments in the invoice area in your client area.
If you wish to cancel this, it can be cancelled at any time by submitting a ticket through your client area requesting it be cancelled, through your PayPal account, or through your client area by visiting here.
1.3.2 Credit or Debit card
We take credit or debit card payments using the Stripe gateway. This gateway uses the Stripe JS library which ensures your data is kept safe. All payments with this gateway are on a recurring basis and will be debited automatically from your account on the invoices due date. All payments through this method are taken in British pound (GBP) regardless of the currency chosen during checkout.
We take Bitcoin payments using the Bitpay gateway. This gateway covers all Bitcoin payments, and converts the payment immediately into Euro (EUR) currency. At no point during the transaction does ServerBlend touch or interact with the Bitcoin currency. Bitcoin payments can take 1 hour to process due to the need for confirmations from the bitcoin network to ensure successful payment. Bitcoin transactions must be confirmed as received and paid in full exclusively by us before a service can be setup.
1.4 Recurring services
Recurring service payment invoices will be created 10 days before the due date, payments must be paid on or before the due date. If your invoice becomes overdue, your service will be suspended, where you service is turned offline and you are unable to access it. If the invoice is not paid within 5 days of being overdue, even if the service has not entered a suspended state prior to this, your service will be terminated, where your service is shut down and all the files deleted. If you are having trouble paying and would like to request a grace period to allow you a longer time to pay, or another method of payment, this may be requested by opening a ticket through your client area. ServerBlend at their sole discretion will decide if the grace period or other method of payment is permitted, and their decision is final.
After cancellation, it is your responsibility to ensure any automatic recurring payments are cancelled.
1.5 Over payments or payment errors
Under some circumstances for example but not limited to: a PayPal auto payment that’s not cancelled, you make a manual payment before a recurring payment is made, a payment is made after the service has been cancelled, may cause you to overpay on your service. This over payment or payment error will be added to your credit balance on your account which can be used on future invoices. You can also request a full refund of the over payment by submitting a ticket through your client area including the transaction ID and method of payment, unless part of the over payment or payment error credit has been used on an invoice. Once partly used, over payments or payment errors cannot be refunded.
In some cases over payments may not be automatically assigned to your ServerBlend account, if this happens, you must notify us by submitting a ticket through your client area including the transaction ID and method of payment. This will then be either added to your accounts credit balance for use on future invoices or can be refunded per your request.
Under no circumstances will we be held liable to a direct or indirect loss of any kind for over payments or payment errors. It is your responsibility to ensure you pay the correct amount and contact us about any over payments or payment errors you have experienced.
1.6 Group Pay
This is a system offered by ServerBlend that allows other users, that do not have an account with ServerBlend to make payments towards a service owned by someone who has an account with ServerBlend. Payments made this way are added to the account holders credit balance. All payments made this way are non-refundable and non-transferable. Once paid, the account holder can use these funds in any way he desires, on any service we provide. A person that has made a payment to another account through this system has no control over what his payment is spent on, or if its spent at all. We do not take any responsibility for what the account holder does with these funds. Payments made through group pay by people other than the account holder does not form any contractual relationship between ServerBlend and the payer, nor confer any rights over the service(s) on the account being paid towards.
1.7 Payment disputes or charge backs
You agree not to open a payment dispute, such as but not limited to: a dispute or claim via PayPal’s dispute system, or open a charge back via your bank or payment provider, under any circumstances.
Doing so will lead to your account and all services being suspended, pending investigation, and can be terminated without refund on the sole decision of ServerBlend.
If you have an issue with a payment, or would like to request a refund, please contact us by opening a ticket via your client area and we will be happy to discuss a solution to your issue or concern with you, however do not guarantee that any solution will be provided.
1.8 Price variations
The amount you pay can vary depending on a few conditions, such as but not limited to:
- Upgrades or downgrades of your service, payment changes will be made aware to your during the upgrade or downgrade process
- Service price decreases, to remain competitive, occasionally we will decrease our prices for all clients.
- Service price increases, to remain competitive and continue to provide the service, a price increase may occur due to, but not limited to, changes in the resource demands of the service.
- Add-on purchases, you will be notified of this price increase when purchasing the add-on.
- Custom admin work. You may request changes to your configuration, or installing of mods, or management work on your service. Before any custom admin work has begun, you will be made aware of the cost, and you will need to agree to it. We will not go forward with any work without your consent.
- Currency conversion differences
- Currency fluctuations that cause the need for us to update your price to be inline with our base currency price, which is the British pound. For example but not limited to; you purchase a service at £8 per month in a different currency, currency fluctuations cause the amount paid by you to decrease to the equivalent of £7, we then update your recurring price to be back at the equivalent value of £8.
For any price variations, you will be made aware of the price change by email before the change is made.
1.9 Client Account Credit
Any client account credit cannot be paid-out in any form, unless otherwise approved by ServerBlend administration under extenuating circumstances. It is restricted to the use of services provided by ServerBlend.
Account credit either provided by us, applied to your account with the Group Pay/ Public pay system, added using add-funds, applied as an overpayment or any other method that is unused for a period of 24 months on an account that has had no active paid service for the past 24 months will receive a dormancy fee of £5 per month or if remaining credit is less than this, the full amount remaining.
2. Setup Procedure
2.1 Setup time and fraud checks
Setup time guarantees only start once we have received cleared payment for the full amount of the invoice, and you have passed our fraud screening system, if you account is highlighted for possible fraud this will lead to an extended setup time, where we contact you to provide suitable verification such as but not limited to: phone verification, address verification or identity verification. For some of our services, or for large value service orders, such as but not limited to: dedicated servers, your order will go through a account verification before we can accept and provision the order where we contact you for verification of your details, by request of identity and address verification. For example, a service that is ordered at 1pm that has a setup time guarantee of 30 minutes, must go through fraud checks and have cleared payment of the full amount of the invoice before the setup time begins. If the checks are completed at 2pm, the setup time would then start and be guaranteed by 2:30pm. Depending on the service purchased, setup time will vary due to factors such as but not limited to: amount of services currently being setup, the load on the server at which your service will be setup on, current available staff, purchased service availability. All game servers other than Space Engineers and Medieval Engineers or otherwise advised are setup automatically after payment and fraud screening pass, usually fully setup within 15 minutes after order. Space Engineers and Medieval Engineers game servers take up to 12 hours to setup as they are setup manually. You are not entitled to any form of monetary or non monetary compensation for any delays in the setup of the purchased service. Verification details you provide such as but not limited too; Government Identification and Bank Statement will be encrypted and stored securely for verification records and to protect us against any charge backs.
Trial servers have no guaranteed setup time.
More than one promotion cannot be used in conjunction with another promotion. Promotions are for example but not limited to: a discount on a service or a free add-on.
ServerBlend cannot guarantee that all promotions will work at all times. Promotions vary in where they can be used and when.
When you trial game server comes to an end at the end of the advised period and you haven’t upgraded or notified us of your interest in upgrading or requesting a trial extension you understand that your server will be cancelled and the files removed.
Any trial extension much be agreed in writing through our support ticket system.
4. Cancelling your service
If you wish to leave us at ServerBlend and cancel your service, this can be done at any time up until your due date by submitting it via your client area or by contacting us. When you submit a cancellation through your client area or by contacting us, you must receive confirmation. If you do not receive confirmation then your cancellation may not have been received, and must be submitted again. Cancellation after the services due date, applies to the next month, and invoices for the current month must then be paid.
If you select immediate cancellation, your server will be cancelled at that time, if you select “At end of current billing period”. Your server will be cancelled on your due date. The server may be cancelled up to 12 hours before 00:01 (24 hour clock) on the due date.
Upon cancellation of the service you may also need to manually cancel any recurring payment you have setup through the payment gateway you chose, such as but not limited to: PayPal. It is the clients responsibility to cancel these recurring payments. If it is not cancelled, you may be charged for a cancelled service. Please contact us and you will be entitled to a full refund of the accidental payment up to the value of 2 months. Other funds will be applied to your accounts credit balance and can be used to purchase future services.
If you wish your client data to be deleted and your account closed, you must request this in writing through our ticket system, and must receive confirmation from us that it has been completed, if you do not hear from us please submit the request again. We reserve the right to keep certain data that is required by us for, legal, fraud prevention and accounting reasons.
6. Specific game server related points
6.1.1 Unlimited slots and player counts.
You can set your slot count to any amount you wish by contacting our support team via ticket through your client area, however this does not mean that your Minecraft server is capable of supporting an unlimited amount of players. Your Minecraft servers RAM, configuration, mods, plugins and more will effect the amount of players that the game server can support. The player count shown on the Minecraft server hosting page does not guarantee that that Minecraft server can support that many players, it may be able to support more or less, it is provided as a guide to the client to assist in their ordering decision.
6.1.2 Unlimited disk space
Our Minecraft servers are provided with unlimited disk space for active server files only under a fair use policy. Server files are configuration, map, mod, plugin and jar files. It does not include non-active mod packs, mods, plugins, maps, jar files, including zipped files. By non-active, this means that they are not in use when the Minecraft game server is online and they have not been used within the past 7 days. We do not permit the client to store multiple unused and non-active mod packs, jars and non-active files on the server as doing so causes a lot of used space that could otherwise be used to supply other clients game servers. We do not permit the client to store any other, unrelated files on the server. The disk space is shared between all game servers on the node therefore we reserve the right to take action to ensure all client game servers have sufficient disk space for normal operation. We reserve the right to remove certain files to ensure this, including but not limited to, zipped files, old backups, old mod files and other files not permitted to be stored on the server. We also reserve the right to terminate accounts without refund that we find abuse our fair use policy.
6.1.3 Minecraft EULA
To operate a Minecraft server the client is required to accept the Minecraft End User License Agreement (EULA), this is a separate legal agreement between the client and Mojang AB. This agreement does not replace our Terms of Service and both must be accepted to operate a Minecraft server.
6.1.4 Free Minecraft Mod Pack Installation Service
This service covers the installation of Mod Pack/s on the clients own Minecraft game server. It is limited to 2 per week (7 days). Additional mods added onto mod packs can be added on an unlimited basis under fair use, meaning that the support staff member can refuse additional mods if deemed extensive or abusive of the service. This free service may be removed or reduced at any time, and we reserve the right to deny or charge for mod pack installs if we decide the client is overusing or abusing this service or if a mod pack has been requested to install that ServerBlend solely decides is attempting to circumvent any of our security, systems or limits, or will cause node instability.
6.1.5 RAM Allocation
RAM is restricted based on the Minecraft game server plan you ordered, this RAM amount covers the entire use of your game server. Therefore any RAM used for additional java flags, for example but not limited “PermGen” will use your allocated RAM and therefore actual RAM in game may not show the full amount of RAM your game server is allocated.
6.1.6 Other Points
- Unless otherwise agreed and authorized in writing by the ServerBlend staff we do not allow the use of any automated backup plugins for Minecraft servers, as using these cause massive disk usage which can cause node instability and negatively effecting other clients services. If authorized, we reserve the right to revoke this at any time. Doing so will result in account termination without refund.
- You are not permitted to use a script, plugin or other way to increase your RAM allocation to more than you have purchased. Doing so will lead to account termination without refund.
- Plugins that allow multiple servers to be on the same package are not permitted unless otherwise agreed and authorised by a ServerBlend staff member through the support ticket system. Examples include sub-servers of the spigot or bukkit plugin. If authorised, we reserve the right to revoke this at any time. Doing so will lead to account termination without refund
6.2 ARK: Survival Evolved
6.2.1 RAM Boost
This is a configurable option for the ARK: Survival Evolved Standard or Custom game servers. It enables the game server to use more than the regular amount of RAM we allow for an ARK: Survival Evolved game server. Therefore enabling the game server to have more dino’s, bigger worlds and more power, when the game server reaches the higher than normal RAM levels. If the game server uses less than the normal amount, the RAM Boost will not be active. The RAM Boost is only effective when the RAM used by the game server exceeds the normal amount we permit for ARK Game Servers.
6.3 Offsite backups
Offsite backups are taken every 24 hours and uploaded to cloud storage on our daily option. The backups are only kept with a history of 7 days, older backups are deleted. For hourly backups they are kept for 2 days. Hourly backups are setup manually, therefore hourly backups will begin 24-48 hours from your servers creation, backups between the time hourly backups are setup and your servers creation will not be available. It may take 48 hours for any daily or hourly backups to be available after your servers creation depending on the time of your order. If you wish to restore a backup you are provided with 5GB download for free each month, in many cases this will be suitable for multiple full backup restorations of your save files. Downloads that exceed this will be charged at £0.05 per GB downloaded, payable at time of download.
The backups do not include mod files or the raw server files, they just backup the save files.
Backups are not taken for any game servers located in our Kansas City location or Minecraft game servers.
Offsite backups are not guaranteed to be available. Upon loss of data, backups may not be available to restore, for example but not limited if our backup storage is compromised. We continue to recommend that you take your own regular offsite backups of your game server save files and we are not liable for any monetary or non-monetary loss in any form for non availability of backups under any circumstances.
6.4 Competitor Relations
By creating a ServerBlend account and/or ordering any product or service you agree that you are in no-way related or affiliated with any other game hosting provider or other competing company.
You will not advertise or otherwise promote in any form a competing company using our service.
6.5 Stated Game Server Slots
The slot count purchased for a game server does not guarantee that your game server can handle this many connected users. It is only the amount of slots that are made available on your game server. This is because the amount of connected players the server can support depends on many factors, such as but not limited to, mods used and configuration settings.
7. Server performance & up time
ServerBlend does not guarantee 100% uptime on the services we provide but we aim to provide as close to it as possible. Sometimes issues can arise which may affect the services we provide to you. For example, but not limited to, a fire in the server room causing the servers to be turned off. You accept that this can happen and that we will do everything we can to resolve any issues that occur as quickly as possible.
If the service you have purchased is Space Engineers and you experience crashes or downtime or other issues, by purchasing the server you understand that Space Engineers being in an early stage of development and server software being in its early stages, some lag, crashes and downtime is expected.
Mods or plugins or other extras you have applied to the server or using applications to otherwise mod the game may affect your game servers performance. You are not entitled to any form of refund, discount or compensation for problems caused by alterations, mods, plugins, add-ons and applications.
ServerBlend will not be held responsible for server side lag or downtime which is caused game server alterations, mods, plugins, add-ons or any type of modification to the service we provide.
If you believe you’re experiencing server side lag please remember to consider your client side variables for example, but not limited to: low frame rate, other people in the household using the same connection, background downloads other programs which may be using bandwidth or system resources. Client side issues are out of ServerBlend’s control.
If it is found with proof and accepted by us that server side lag is being caused our side and is in our control you are entitled to credit added onto your account for each day the issue continues up to a maximum of the full price paid of the current game servers month, if the game server is on a quarterly, semi-annual or annual billing term, this will apply to a maximum of one month for each separate lag incident, up to the full price paid of the game server.
We do not guarantee a lag free or issue free experience, because your services performance and reliability depends on many factors, such as but not limited to, configuration settings, mods used and server hardware.
You also accept that sometimes there may be downtime due to the need for maintenance, upgrades and updates. In most cases we will notify you 24 hours before downtime will occur via email and on our social media pages; Twitter and Facebook. For some very short downtime, such as quick server restarts, will be done during non-peak times and notification sent out only via social media.
Unless otherwise agreed in writing you are not entitled to any form of payout, discount, monetary or non-monetary compensation, service change, service extension or extra time, or any other form of return due to service issues.
8. Hardware Specifications
The hardware specification listed in our game server configuration tool (here) is the server hardware that the individual game server will be placed on, the hardware is then shared with all game servers on that server, it is not the amount the individual game server is allowed to use. Speeds shown here may very from what is exactly received, as CPU speed can fluctuate for many difference reasons.
9. Acceptable Usage Policy
The business model of providing shared hosting, involves placing ‘x’ amount of services on one server and to share the resources between these. Therefore server CPU, disk space and RAM are shared resources, excessive consumption of these resources can interfere with or completely prevent normal service performance for other users. ServerBlend reserves the right to suspend or terminate services on any account that, at its sole discretion, is abusing server resources. Such suspension will cause the service to be shut down and can occur at any time without prior warning. Your server files will remain and you will be sent an email about the shut down or / and suspension. Action is then required to reduce your usage or account for your higher usage. If we find that you are not acting on emails sent and your usage remains continually above acceptable amounts, ServerBlend reserves the right to remove access and with continual non cooperation, termination with file deletion of the service may occur without refund.
ServerBlend reserves the right to run restarts, updates, commands, cleanups, at any time on client services, such as but not limited to; a game server, to which at its own sole discretion is or may cause system instability, resource abuse or effect other clients negatively, due to but not limited to: a bug, in-game objects or script. This is to ensure all ServerBlend services run optimally and to avoid any disruption to any other clients
You shall only use ServerBlend’s services for lawful purposes, you shall not let any third party to commit unlawful actions on any of ServerBlend’s services. Transmission, storage, or presentation of any information, data, or material in violation of the laws of the United Kingdom is prohibited.
This includes, but is not limited to: copyrighted material in which you are not the copyright holder, material that is threatening or obscene, or material protected by trade secrets or other statutes. You agree to indemnify and hold harmless ServerBlend (Interiginal LTD), from any claims resulting from the use of the service which damages you or any other party. ServerBlend reserves the right to terminate any services for any customer or end-user activity that exposes it to legal liability or endangers its ability to provide services to other clients.
10. Full or Unavailable Server configurations
If we, or our automatic provisioning system comes to setup your game server and find out that the clients chosen location or configuration for their service is currently full or unavailable, for whatever reason, decided solely by ServerBlend. The service will be placed on the server with the closest configuration similarity, decided by ServerBlend. If this happens the client may request to be put on the originally chosen configuration as soon as available and is provided with an extended, any reason, refund policy of 15 days.
11. Best Price Guarantee
Our best price guarantee where we will beat a competitors price if found cheaper, must be: 1) Same slot count 2) Same location 3) Similar hardware level. We reserve the right to refuse price beats if we deem at our sole discretion that it is not a reasonable equivalent, for example but not limited to: the competitor provides the service on lower end hardware, the competitor is not reputable. When we are unable to beat the price of a competitor we aim to provide a free months service instead which then recurs automatically at the regular price, the client may submit a cancellation 24 hours before their due date to not be charged, payments made are non refundable. We may at our sole discretion also not provide a free month, if for example, but not limited too; the size of the game server is very large. Applies to the standard game server and all configurable options, however add-ons are not included.
12. DDOS Protection
At some locations we provide a certain degree of DDOS Protection on our servers. Depending on the severity, type and duration of the attack and the server that is attacked, game servers may still be affected. We will not be held liable for downtime caused by DDOS attacks. Services we suspect or are found to be targeted by DDOS causing other services to be disrupted may be shut down to ensure other services are not effected. We reserve the right to suspend or terminate services that are targeted by DDOS attacks.
13. Service Termination
ServerBlend reserves the right to suspend or terminate at its sole discretion any service that does not follow the Terms of Service.
For example but not limited to: Infringing copyright, fraud, abusing server resources, not following our usage policy or not following our payment terms.
If your service is terminated or cancelled, the related files will be deleted and are non-recoverable.
14. Data loss and protection
ServerBlend will not be held responsible for the backing up and integrity of client data, and is not liable in any form, for any form of loss caused by the loss of client data.
It is the client’s responsibility to ensure off-site backups are taken of their services files regularly.
13. Securing of service accounts
In any situation where a client account, game server account or server itself is hijacked or hacked, ServerBlend will not be held responsible for this. It is the clients responsibility to keep all their personal details and passwords secure and personal. ServerBlend is not liable for any form of loss caused by this, for example but not limited to, financial loss, game time or game saves.
You are fully responsible for the security of your account, you must ensure that your password is strong and that it is not shared and any other security procedures are taken. We are not responsible in any way or form if you provide access to another individual to your account with your password of by creating them a sub-account, or they gain access through any other means. You are also responsible for any users you authorise to access your account and the security of any sub-accounts. Any user who is able to log into your account or login to a sub-account you have created will then be able to purchase further services from us and therefore charge your payment method such as but not limited to, your credit card or PayPal account. Purchases made from your account will be deemed authorised by you and cannot be refunded outside of our normal policy, we will not be help liable for any form of loss, whether monetary or non-monetary, in any way or form, for any such purchases or other actions on your account.
15. Service Add-ons
Service add-ons, for example but not limited to, “monitor and fix” are attached to the related service. They are cancelled as soon as the service it is an add-on for is cancelled or terminated. If a service is suspended, the service add-on attached to it is also suspended.
If the paid amount each month is less than £4, you do not qualify for free add-ons.
Configuration or mod installation add-ons entitles the client to up to 3 mods, and 30 mins of work each purchase. If more work is required, additional add on purchases will be needed or the client can purchase our ‘Complete In-House Management’ add on.
15.1. Complete In-House Management
This add-on has been created to remove the hassle of managing, configuring and setting up your server. This enables you to hire someone to do it for you. Up to a maximum of 3 and a half hours paid with half an hour free! Making a total of 4 hours a month. If your server is very large, active and requires more cleanups and configuration. This can be increased on request for an extra charge.
15.1.1 Space Engineers
When we manually cleanup, accidental deletions of player content may occur, every time we clean up a server we will take a backup. You will have 2 days after a cleanup to contact us to restore the backup if accidental content has been deleted, and we will restore the backup. On rare occasions backups can become corrupt, it is your responsibility to ensure regular backups are kept, we are not responsible for backups. With automated cleanups, this is done through external, third party software, we will tell you what settings we have setup which you will need to tell your players about. The software may be unreliable, and we are not responsible if content is lost through automated cleanups, because of the automated nature, backups before automated cleanups cannot be taken.
15.1.2 ARK: Survival Evolved
Covers changes to the configuration throughout the billing period and the installation and support for mods at any point. We are not responsible for updates to ARK servers as this is a manual process all clients can manage via the control panel. ARK mods can be updated on request by contacting support. Please note we are not responsible for mods that cause issues with the server failing to load a map from mod corruption, bugs or broken mods but will assist with our advanced mod support to diagnose the issue.
15.2 “Monitor and Fix”
This service detects when the game server’s process is not running, when this is detected, we will as soon as possible intervene and fix the issue for the client without the need for the client to contact us. There is no guarantee on when we can fix and bring the game server back online due to the nature of issues and availability. It does not cover initial configuration issues for when the client first sets up their configuration and it does not work. The server must have run with players connected at-least once before.
This service cannot detect if the game server can be connected to. If this happens you will need to notify us of this issue.
This add-on is available to select packages, with varying sizes and types. You are entitled to one GameVox voice server per account, regardless of amount of services active. You will be provided with a code to redeem with GameVox, once that GameVox code time runs our, if your service is still active and paid for, you may claim another GameVox voice server code, as-long as we still have GameVox codes available and the add-on is still available to be ordered by new clients.
The maximum GameVox voice server you are entitled to is 200 slots for 12 months. GameVox will be shown as a trial in your GameVox account.
This add-on applies to new Enjin websites and sign ups only, if you have had Enjin before you may not be able to claim the free 45 day advanced trial.
If Enjin denies your trial for any reason, this is not our responsibility, you will need to contact Enjin about it.
Sub-domains are removed when the service associated is cancelled, they cannot be used on services outside of ServerBlend’s control or set to an IP that is not controlled by ServerBlend. Sub-domains cannot be used for any purpose that may cause damage to ServerBlend’s brand, reputation, name or other asset. If we suspect a sub-domain is being used in a way that may cause damage or is used for any unlawful or defamatory purpose, we reserve the right to remove the sub-domain without refund.
The term ‘Partner’ on ServerBlend referrers to someone who is affiliated or works with ServerBlend. For example but not limited to, it can be known as someone who is ‘Sponsored’ by us with a free service. This could be a YouTube channel that we Sponsor, or a website that we have advertisements on.
17. Support Service
We provide a 24/7 support service, however a support representative may not be available at all times, 100% of the time. Due to for example, but not limited to, if a member of the team is ill, on leave, or otherwise unable to connect to the support system due to for example but not limited to, an internet issue or computer issue. We aim to resolve all issues sent to our support system as quick as possible, however we do not guarantee when and if any issue will be resolved due the the vast amount of possible issues that may occur. With each message to our support system you will receive a confirmation email, if you do not receive any email, the message may have not been received, in which case, we recommend sending it again, or submitting it directly through your client area after logging in.
17.1 Support Tips
We offer the ability for the client to “tip” a support representative if they wish too. This does not effect the support service provided to the client and is completely optional. The client can do this by sending any amount of Ether or Bitcoin to the Ethereum (Ether) or Bitcoin address provided to them. We cannot under any circumstances provide refunds for tips. The tips are sent to that support representatives Ethereum (Ether) or Bitcoin account and is not under control by Interiginal LTD. It is the clients responsibility to ensure that the amount sent is sent to the correct address and with the correct amount of “gas” for the transaction to complete. If you are not fully aware of how to correctly use and the risks associated with the Ethereum (Ether) or Bitcoin system you agree not to send anything. If the address provided to you for the support representatives Ethereum (Ether) or Bitcoin address is incorrect, for example but not limited to, if a typo is made when providing you with the address, we are not liable and will not provide refunds for this. You are fully responsible for any use of this “tip” system, and you may only use it if you are fully aware of the risks associated.
18. Feedback and Information
Any feedback or review you provide on our website, through the Trustpilot review service, through ticket, or on external websites about our service shall be deemed to be non-confidential. ServerBlend shall be free to use, publish and display such information on an unrestricted basis as it sees fit.
The client agrees to receive review or feedback request emails from us or through the Trustpilot email service.
As part of the Trustpilot service we must pass the clients personal details such as but not limited to, email address, first name, ServerBlend account and order number, to Trustpilot and their servers, in order to send review or feedback invitations. The client consents to the transferal of personal details in order to fulfil this and send out emails and keep a record of if they have been sent an email, when and if they have submitted a review.
By using the website, you acknowledge and agree that Internet transmissions are never completely private or secure, you understand that any message or information you send to the website may be read or intercepted by others, even if there is a special notice that a particular transmission such as, but not limited to: credit card information, is encrypted.
There may be links to third-party websites throughout the ServerBlend website, these third-party websites are outside of the control of ServerBlend and are provided as a convenience to you. We are not responsible and we do not endorse these third party websites. You must make your own independent judgment regarding your interaction with these linked websites.
You should be aware that by signing up for an account with ServerBlend (Interiginal LTD), you agree to position data on our servers, therefore making it accessible to the public. In this sense, you accept that it is beyond the power of ServerBlend (Interiginal LTD), to restrict such access and guarantee the security of your files. You are completely in charge of protecting your data.
20. Data Redundancy
Your use of ServerBlend’s services is at your sole risk. We are not responsible for your files and/or data residing on your account. You agree to take full responsibility for your files and data transferred and to keep regular backups of files and data stored on our servers. All backup services provided by us are offered with no warranty or guarantee of their date, accuracy and integrity.
Below are security terms which any person breaking will be subject to the full force of the law, and may be subject to extra costs coming from for example but not limited to legal fees.
Your account is your sole responsibility and that you will accept the consequences of any breach of the Terms of Service under services connected to your account or any activities associated and occur under your account, and the security of your account is your responsibility, and that you will keep your passwords confidential.
You agree NOT to:
Perform or cause any attack on the network, host or server, for example but not limited to, “Denial of Service” attacks or attempting to crash or disable a server.
Engage in any activities that may interfere or interrupt services we “ServerBlend” provide.
- Engage in any illegal activities on any of our services.
Circumvent ServerBlend’s security features for any reason.
Reproduce, sell or trade ServerBlend’s services
- Charge back or otherwise retrieve funds previously paid to ServerBlend in an attempt to bypass our refund policy. If you are not happy, please contact us, we are more than happy to resolve any issues you have. Chargebacks may be followed up by debt collectors and if necessary taken to court to recover the funds, if this is done, all costs associated are liable to be paid by the client.
Some of the data we have on the ServerBlend website are from or created by third parties. If we are told any data on the website is copyrighted, we will remove it as soon as possible after we are contacted with relevant proof by the rightful owner to our abuse department: abuse(at)serverblend.com. The submitter will be liable for the copyright abuse not ServerBlend.
23. Terms of Service Definitions
“Node” or “Server”: These are terms used for the server that the game servers are provided on in shared hosting environment.
24. Limitations of Liability:
Except where prohibited by law, in no event will Interiginal LTD be liable to you for any indirect, consequential, exemplary, incidental or punitive damages, including lost profits, even if Interiginal LTD has been advised of the possibility of such damages.
You expressly acknowledge and agree that to the fullest extent permitted by applicable law Interiginal LTD, shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses.
Under no circumstances, shall we be held liable for any data loss, distribution of information including unauthorised access to ServerBlend server systems or any other loss of data. ServerBlend will not be held liable for any disruption, delay, or disconnection of services for any period of time.
If Interiginal LTD is found to be liable to you for any damage or loss which arises out of or in any way connected with your use of the site, content or services, ServerBlend’s liability shall in no event exceed the greater of (1) the total of any subscription or similar fees with respect to the service provided paid in the previous three months prior to the date of the initial claim. (2) £100.00. Some jurisdictions do not allow limitations of liability, so the foregoing limitation may not apply to you.
You agree to indemnify and hold Interiginal LTD, its officers, directors, shareholders, predecessors, successors in interest, employees, agents, subsidiaries and affiliates, harmless from any demands, loss, liability, claims or expenses (including legal fees), made against Interiginal LTD by any third party due to or arising out of or in connection with your use of the site and services.
26. Requests for Custom Information
The client agrees that ServeBlend may in response to a formal or informal request from a law enforcement or regulatory agency or in response to a formal request in a civil action that on its face meets the requirements for such a request, without notice to the client:
a) Report to the appropriate authorities any conduct by the client that ServerBlend reasonably believes violates applicable law
b) Provide any information that it has about the client
c) Report client data as otherwise required to by law
You agree that:
ServerBlend (Interiginal LTD) disclaims all conditions, warranties and other terms of any kind, whether express or implied.
That we do not promise that the site or any content, service or feature will be error-free or uninterrupted or that any defects will be corrected or that your use of website and/or services will provide any specific result. The website and services are provided on an as-is basis.
No advice or information, obtained by you from ServerBlend through, or from the service shall create any warranty or other obligation not expressly stated in the Terms of Service.
28. Force Majeure
ServerBlend shall not be in default of any obligation under the agreement if the failure to perform the obligation is due to any event beyond ServerBlend’s control, including, without limitation, significant failure of a portion of the power grid, significant failure of the internet, natural disaster, war, riot, insurrection, epidemic, strikes or other organized labor action, terrorist activity, or other events of a magnitude or type for which precautions are not generally taken in the industry.
